The Jack Olsta Co. Terms and Conditions
Terms:
Terms previously agreed upon by The Jack Olsta Co. and the Buyer will be dated on the day of shipment unless circumstances prevent such actions. An example would be a computer malfunction or any other circumstances beyond the control of the Seller. If credit arrangements have not been made with The Jack Olsta Co. or if there is a change in the financial condition of the Buyer, The Jack Olsta Co. may require full payment in advance.
Shipping Policy:
The Jack Olsta Co. reserves the right to determine the most efficient method of fulfilling and shipping an order. Some products may ship directly from the manufacturer or an authorized supplier. Unless specific shipping instructions are provided by the Buyer and accepted by The Jack Olsta Co., the carrier, shipping method, and routing will be selected at our discretion.
The Jack Olsta Co. does not automatically insure shipments beyond the carrier’s standard liability coverage. Additional shipping insurance is available upon request and at the Buyer’s expense. Buyers should inspect shipments upon receipt and report any damage or shortages immediately. Claims for loss, damage, or shortages occurring during transit must be filed with the carrier.
Same Day Shipping:
In-stock products are typically shipped the same business day when an order is received by 3:00 PM CST. Orders received after 3:00 PM CST, on weekends, or on holidays will be processed on the next business day. Same-day shipping is not guaranteed and may be affected by product availability, carrier schedules, weather conditions, or other circumstances beyond our control.
Free ground shipping:
Free ground shipping may be available on qualifying online orders totaling more than $1,000, provided the total package weight is less than 50 lbs. Eligibility is determined at checkout and may exclude oversized, hazardous, freight, or manufacturer-direct shipments. This offer is subject to change without notice.
Taxes:
Any taxes which The Jack Olsta Co. may be required to pay or collect, under any existing or future law, upon or concerning the sale, delivery, processing, use, or transportation of any products sold to the Buyer, including taxes upon or measure by, the receipts from such sale, shall be the responsibility of the Buyer, and Buyer shall pay the amount thereof to the Seller upon demand. Or in lieu thereof, the Buyer shall provide The Jack Olsta Co. with a tax-exempt certificate acceptable by the taxing authorities.
Quotation and Prices:
Prices are subject to change without notice.
Liability:
The Jack Olsta Co. shall not be liable for any loss or damage of any kind resulting from delay and inability to deliver on account of fire, labor troubles, accidents, acts of civil or military authorities, or any other cause beyond the control of The Jack Olsta Co.
Limited Warrenty:
The Jack Olsta Co. does not manufacture any parts and it will pass on to the Buyer any warranty from the live manufacturer as determined and authorized by such manufacturer. Any damage caused by The Jack Olsta Co. shall be limited to replacement or repair, and in no event shall The Jack Olsta Co. be liable for consequential or special damages, or for transportation, installation, adjustment, or other expense which may arise in connection with such parts. The Jack Olsta Co. MUST be notified within 10 business days after receipt of goods of any defective parts. THIS LIMITED WARRANTY IS EXPRESSLY MADE IN LIEU OF ANY AND ALL OTHER WARRANTIES EXPRESSED OR IMPLIED INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS.
Cancellation:
An order placed with and accepted by The Jack Olsta Co. can be canceled only with the consent of The Jack Olsta Co.
Returned Parts:
Parts should not be returned to The Jack Olsta Co. without first contacting The Jack Olsta Co. If The Jack Olsta Co. authorizes the return of parts, the parts should be properly packaged to reach The Jack Olsta Co. OR another agreed-upon destination without damage.
